Customer Relationship Management Privacy Notice

This notice explains how Ferring manages your information for Customer Relationship Management (“CRM”). For other ways of interacting with Ferring, or doing business with us, please see the notices for those categories.

Legal Information

Data Controller

Ferring Pharmaceuticals Pty. Ltd. ABN 87 003 037 170 (“Ferring”) located at 20 Bridge Street, Pymble, NSW, Australia is responsible for the handling of your information. This responsibility may be exercised alone or jointly with other companies in the Ferring Group.

 

Personal Data

The following information is collected:

  • Identification Data and Contact Details (e.g., name, age, telephone number, email, login details);
  • Professional Information (e.g., workplace, position, medical field, qualifications, scientific activities, publications, credentials, congress activities, awards);
  • Financial Details (e.g., payment information, bank account details, tax identification);
  • Interaction Details (e.g., your interests, topics and materials discussed, feedback, prescribing habits, routines related to your use of our products, digital interaction data during your visits on our designated websites).

We obtain the Personal Data directly from you (such as through Ferring websites, apps, forms, emails, agreements or if you call us directly) or indirectly through Ferring’s activities such as conferences, seminars or programs organised by Ferring, publicly available sources, and third parties. Where you prefer that we do not collect your personal information, we may not be able to provide assistance and undertake activities that we would otherwise provide or undertake.

Kindly note that third parties such as our vendors assisting Ferring provide services to you may gather your personal data. We advise reviewing their privacy notices for further clarification.

 

Purpose

Your Personal Data is used in accordance with the applicable Ferring Group privacy policy for purposes including:

  • Enhancing our relationship with you, such as providing relevant information and tailoring communications to your needs, inviting you to medical events/congresses, or improving our interactions;
  • Complying with the terms and conditions specified in our agreements with you, which may involve activities such as medical events, advisory meetings, and, where applicable, reimbursing your expenses;
  • Fulfilling our legal obligations such as mandatory regulatory information and transparency requirements and confirming your identity.

 

Legal Basis

Your Personal Data will only be handled and used for the purposes above if:

  • we have obtained your consent according to applicable data protection and privacy laws, regulations, and directives;
  • we need to perform contractual obligations towards you or take pre-contractual steps at your request;
  • we need to comply with our legal, regulatory, or reporting obligations or to comply with a court/authority order; or
  • we have a legitimate business interest such as developing and improving our products or services or marketing, or managing our business operations.

Data Sharing

For the purposes listed above, third parties, such as those listed below may have access to your Personal Data:

  • Companies within the Ferring Group;
  • Suppliers and service providers (e.g., cloud providers, consultants, hosting suppliers, communications agencies, travel and events agencies, database providers such as IQVIA);
  • Business partners;
  • Competent supervisory, regulatory authorities, or courts.

When transferring Personal Data to a third party outside the European Economic Area (EEA) without an adequate level of data protection according to relevant authorities, we will protect your Personal Data by using Standard Data Protection Clauses or another transfer mechanism and by conducting a Transfer Impact Assessment (TIA).

 

Retention

Ferring will retain the Personal Data for a maximum period of 10 years after termination of our business relationship, or such longer period required by applicable law, so that Ferring can comply with its legal obligations.

 

Your Rights

Under EU and UK laws, you have the right to access, rectify, update, delete, object, limit the processing of your Personal Data, request data portability and withdraw your consent. You can exercise these rights (where applicable) by contacting Ferring via the Data Subject Contact Form, or contacting your Ferring affiliate such as set out further below for Australia.

You can unsubscribe from any marketing communications at any time by clicking “unsubscribe” or the “opt-out” link in the emails from Ferring.

Security

We maintain appropriate technical and organizational measures to safeguard Personal Data from unauthorized access or loss. While we continually monitor and update this security measures, please note that online protection is a shared responsibility.

Notice to Australian Residents:

Our Australian resident customers are notified that:

(a) in this Notice, “personal data” includes the meaning given to “personal information” under the Australian Privacy Act, and Australian privacy requirements we comply with include the Privacy Act 1988 (Cth) including the Australian Privacy Principles, the Spam Act 2003 (Cth), the Do Not Call Register Act 2006 (Cth) and applicable state/territory health privacy laws and any mandatory standards or industry codes.

(b) as explained further in Ferring’s Privacy Policy for Australia on our website (www.ferring.com.au/privacy/), your personal information may be transferred to, stored and processed in a country outside Australia, such as in Switzerland (where Ferring is headquartered), or in the United States where the service provider managing this platform is located. When we pass on, transfer or share your information in this way, we will take steps to ensure that your personal information is protected, and do this in a number of ways including putting in place appropriate contracts.

We do not impose any charge for a request for access, but we may charge you a reasonable fee for our costs associated with providing you with access and retrieval costs. For complaints about privacy, we will establish in consultation with you a reasonable process, including timeframes, for seeking to resolve your complaint.
